Philosophers of science turned to historical case studies in part in response to Thomas Kuhn's insistence that such studies can transform the philosophy of science. In this issue Joseph Pitt argues that the power of case studies to instruct us about scientific methodology and epistemology depends on prior philosophical commitments, without which case studies are not philosophically useful. Here I reply to Pitt, demonstrating that case studies, properly deployed, illustrate styles of scientific work and modes of argumentation that are not (...) well handled by currently standard philosophical analyses. I illustrate these claims with exemplary findings from case studies dealing with exploratory experimentation and with interdisciplinary cooperation across sciences to yield multiple independent means of access to theoretical entities. The latter cases provide examples of ways that scientists support claims about theoretical entities that are not available in work performed within a single discipline. They also illustrate means of correcting systematic biases that stem from the commitments of each discipline taken separately. These findings illustrate the transformative power of case study methods, allow us to escape from the horns of Pitt's "dilemma of case studies," and vindicate some of the post-Kuhn uses to which case studies have been put. This study is a phenomenological inquiry into several relatively unexplored phenomena, including certain key methodological issues. It seeks to elicit and explicate the grounds of free-fantasy variation, which Husserl insists contains his “fundamental methodological insight” since it articulates “the fundamental form of all particular transcendental methods…” In the course of pursuing the full sense of this method and its grounds, the essay also uncovers the origins and eventual presence of “self” and explores the multiple connections among self, mental life, embodiment (...) and the surrounding world. To that end, it is necessary to take seriously Husserl’s otherwise odd declaration that “‘feigning’ [‘Fiktion’] makes up the vital element of phenomenology as of every other eidetic science…”, and thus that every philosopher must “fertilize” his or her “fantasy” through works of art and history as well as other areas and practices of human life. The essay offers an in-depth probing of several striking but largely unexplored phenomena: exemplifying and possibilizing, and concludes with an exploration of one of the most pervasive themes in phenomenological inquiry: intersubjectivity. Zen and Japanese Culture is one of the twentieth century's leading works on Zen, and a valuable source for those wishing to understand its concepts in the context of Japanese life and art. In simple, often poetic, language, Daisetz Suzuki describes his conception of Zen and its historical evolution. He connects Zen to the philosophy of the samurai, and subtly portrays the relationship between Zen and swordsmanship, haiku, tea ceremonies, and the Japanese love of nature. Suzuki's contemplative work is enhanced (...) by anecdotes, poetry, and illustrations showing silk screens, calligraphy, and examples of architecture. Since its original publication in 1938, this important work has played a major role in shaping conceptions of Zen's influence on Japanese traditional arts. Richard Jaffe's introduction acquaints a new generation of readers with Suzuki's life and career in both Japan and America. Jaffe discusses how Zen and Japanese Culture was received upon its first publication and analyzes the book in light of contemporary criticism, especially by scholars of Japanese Buddhism. (shrink)

Autonomy has been central to moral and political philosophy for millenia, and has been positioned as a critical aspect of both justice and wellbeing. Research in psychology supports this position, providing empirical evidence that autonomy is critical to motivation, personal growth and psychological wellness. Responsible AI will require an understanding of, and ability to effectively design for, human autonomy (rather than just machine autonomy) if it is to genuinely benefit humanity. Yet the effects on human autonomy of digital experiences are (...) neither straightforward nor consistent, and are complicated by commercial interests and tensions around compulsive overuse. This multi-layered reality requires an analysis that is itself multidimensional and that takes into account human experience at various levels of resolution. We borrow from HCI and psychological research to apply a model (“METUX”) that identifies six distinct spheres of technology experience. We demonstrate the value of the model for understanding human autonomy in a technology ethics context at multiple levels by applying it to the real-world case study of an AI-enhanced video recommender system. In the process we argue for the following three claims: 1) There are autonomy-related consequences to algorithms representing the interests of third parties, and they are not impartial and rational extensions of the self, as is often perceived; 2) Designing for autonomy is an ethical imperative critical to the future design of responsible AI; and 3) Autonomy-support must be analysed from at least six spheres of experience in order to approriately capture contradictory and downstream effects. The National Center for Biomedical Ontology is a consortium that comprises leading informaticians, biologists, clinicians, and ontologists, funded by the National Institutes of Health (NIH) Roadmap, to develop innovative technology and methods that allow scientists to record, manage, and disseminate biomedical information and knowledge in machine-processable form. The goals of the Center are (1) to help unify the divergent and isolated efforts in ontology development by promoting high quality open-source, standards-based tools to create, manage, and use ontologies, (2) to create (...) new software tools so that scientists can use ontologies to annotate and analyze biomedical data, (3) to provide a national resource for the ongoing evaluation, integration, and evolution of biomedical ontologies and associated tools and theories in the context of driving biomedical projects (DBPs), and (4) to disseminate the tools and resources of the Center and to identify, evaluate, and communicate best practices of ontology development to the biomedical community. Through the research activities within the Center, collaborations with the DBPs, and interactions with the biomedical community, our goal is to help scientists to work more effectively in the e-science paradigm, enhancing experiment design, experiment execution, data analysis, information synthesis, hypothesis generation and testing, and understand human disease. In this paper we use an experimental approach to investigate how linguistic conventions can emerge in a society without explicit agreement. As a starting point we consider the signaling game introduced by Lewis. We find that in experimental settings, small groups can quickly develop conventions of signal meaning in these games. We also investigate versions of the game where the theoretical literature indicates that meaning will be less likely to arise—when there are more than two states for actors to transfer (...) meaning about and when some states are more likely than others. In these cases, we find that actors are less likely to arrive at strategies where signals have clear conventional meaning. We conclude with a proposal for extending the use of the methodology of experimental economics in experimental philosophy. (shrink)

Da análise dessas variáveis, o autor procura esclarecer a figura conflituosa do akratic (incontinente) e do akalastos (perverso) e elucidar a hipótese do desenvolvimento moral. Concomitantemente este artigo pretende introduzir o problema criminológico da ideia de ressocialização ou da pena capital, entendendo ser o argumento aristotélico ainda influente para a filosofia da virtude e jurídica hodierna e necessário quando se discutem novos paradigmas éticos e jurídicos. Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...) explaining variance in ethical behaviors than do values at the societal-level. Implicitly, our findings question the soundness of using societal-level values measures. Implications for international business research are discussed. (shrink)

Co-authored letter to the APA to take a lead role in the recognition of teaching in the classroom, based on the participation in an interdisciplinary Conference on the Role of Advocacy in the Classroom back in 1995. At the time of this writing, the late Myles Brand was the President of Indiana University and a member of the IU Department of Philosophy.

Investigation of neural and cognitive processes underlying individual variation in moral preferences is underway, with notable similarities emerging between moral- and risk-based decision-making. Here we specifically assessed moral distributive justice preferences and non-moral financial gambling preferences in the same individuals, and report an association between these seemingly disparate forms of decision-making. Moreover, we find this association between distributive justice and risky decision-making exists primarily when the latter is assessed with the Iowa Gambling Task. These findings are consistent with neuroimaging studies (...) of brain function during moral and risky decision-making. This research also constitutes the first replication of a novel experimental measure of distributive justice decision-making, for which individual variation in performance was found. Further examination of decision-making processes across different contexts may lead to an improved understanding of the factors affecting moral behaviour. (shrink)

Throughout the biological and biomedical sciences there is a growing need for, prescriptive ‘minimum information’ (MI) checklists specifying the key information to include when reporting experimental results are beginning to find favor with experimentalists, analysts, publishers and funders alike. Such checklists aim to ensure that methods, data, analyses and results are described to a level sufficient to support the unambiguous interpretation, sophisticated search, reanalysis and experimental corroboration and reuse of data sets, facilitating the extraction of maximum value from data sets (...) them. However, such ‘minimum information’ MI checklists are usually developed independently by groups working within representatives of particular biologically- or technologically-delineated domains. Consequently, an overview of the full range of checklists can be difficult to establish without intensive searching, and even tracking thetheir individual evolution of single checklists may be a non-trivial exercise. Checklists are also inevitably partially redundant when measured one against another, and where they overlap is far from straightforward. Furthermore, conflicts in scope and arbitrary decisions on wording and sub-structuring make integration difficult. This presents inhibit their use in combination. Overall, these issues present significant difficulties for the users of checklists, especially those in areas such as systems biology, who routinely combine information from multiple biological domains and technology platforms. To address all of the above, we present MIBBI (Minimum Information for Biological and Biomedical Investigations); a web-based communal resource for such checklists, designed to act as a ‘one-stop shop’ for those exploring the range of extant checklist projects, and to foster collaborative, integrative development and ultimately promote gradual integration of checklists. Recalling Thomas Nagel’s discussion concerning the difficulties associated with developing a scientific explanation for the nature of experience, Nagel states that current reductionist attempts fail by filtering out any basis for consciousness and thus become meaningless since they are logically compatible with its absence. In this article we call into question the fundamental philosophy of the mind-brain identity hypothesis of Cognitive Theory: ‘What processes in the brain give rise to awareness?’ and the associated search for ‘neural correlates of consciousness’ (NCC). (...) The proper scientific manner of posing the query should simply be ‘What processes give rise to awareness?’. We begin to formalize the Eccles psychon and summarize one of fourteen empirical protocols to test this putative model. This requires a new science of Unified Field, UF Mechanics, entailing in terms of our current stage of development operationally completed forms of quantum theory, gravitation and cosmology arising from a unique derivation of the M-Theory (string theoretic) vacuum. Until now the quest for psychophysical bridging has typically been in the arena between brain and quantum geometry; and many have wondered if contemporary science is sufficient for the task. Nagel further asks ‘what would be left if one removed the viewpoint of the subjective observer’ and then suggests ‘that the remaining properties would be the physical processes themselves or states intrinsic to the experience of awareness’. We examine a new theoretical framework for introducing and experimentally testing the underlying physical cosmology of these noetic parameters. (shrink)

Propositional logics in general, considered as a set of sentences, can be undecidable even if they have “nice” representations, e.g., are given by a calculus. Even decidable propositional logics can be computationally complex (e.g., already intuitionistic logic is PSPACE-complete). On the other hand, finite-valued logics are computationally relatively simple—at worst NP. Moreover, finite-valued semantics are simple, and general methods for theorem proving exist. This raises the question to what extent and under what circumstances propositional logics represented in various ways can (...) be approximated by finite-valued logics. It is shown that the minimal m-valued logic for which a given calculus is strongly sound can be calculated. It is also investigated under which conditions propositional logics can be characterized as the intersection of (effectively given) sequences of finite-valued logics. (shrink)

According to Tye's PANIC theory of consciousness, perceptual states of creatures which are related to a disjunction of external contents will fail to represent sensorily, and thereby fail to be conscious states. In this paper I argue that heat perception, a form of perception neglected in the recent literature, serves as a counterexample to Tye's radical externalist claim. Having laid out Tye's absent qualia scenario, the PANIC theory from which it derives and the case of heat perception as a counterexample, (...) I defend the putative counterexample against three possible responses: (1) that heat perception represents general (i.e. non-disjunctive) intrinsic properties of objects, (2) that heat perception represents the non-specific heat energy that is transferred between a subject's body and another body and (3) that heat perception exclusively represents heat properties of the subjects own body. This analysis shows Cantor's diagonal definition in his 1891 paper was not compatible with his horizontal enumeration of the infinite set M. The diagonal sequence was a counterfeit which he used to produce an apparent exclusion of a single sequence to prove the cardinality of M is greater than the cardinality of the set of integers N.

Contingency is the presence of non-actualized possibility in the world. Fatalism is a view of reality on which there is no contingency. Since it is contingency that permits agency, there has traditionally been much interest in contingency. This interest has long been embarrassed by the contention that simple and plausible assumptions about the world lead to fatalism. I begin with an Aristotelian argument as presented by Richard Taylor. Appreciation of this argument has been stultified by a question pertaining to (...) the source of necessity and possibility and a closely related one regarding the nature of metaphysics itself. Answering these questions reveals the crucial issue here, to wit, necessity and possibility in a temporal world. This issue is investigated through an important later criticism of Taylor by David Foster Wallace. Wallace’s critique is significant because it brings to the fore the pivotal notion for understanding contingency in a temporal world, that of synchronic possibility, the idea that incompatible states of affairs are possible at a single moment. This notion provides the basis of distinguishing two systematic accounts of truth, modality and time: two metaphysics of contingency. On one account, Taylor’s Aristotelian argument is straightforwardly valid and compelling; on the other, it is fallacious. In closing, I present reasons why the former account, supporting the Aristotelian views of time and truth, is correct and make some comments to ameliorate this conclusion. (shrink)

Is capitalism inherently predatory? Must there be winners and losers? Is public interest outdated and free-riding rational? Is consumer choice the same as self-determination? Must bargainers abandon the no-harm principle? Prisoners of Reason recalls that classical liberal capitalism exalted the no-harm principle. Although imperfect and exclusionary, modern liberalism recognized individual human dignity alongside individuals' responsibility to respect others. Neoliberalism, by contrast, views life as ceaseless struggle. Agents vie for scarce resources in antagonistic competition in which every individual seeks dominance. This (...) political theory is codified in non-cooperative game theory; the neoliberal citizen and consumer is the strategic rational actor. Rational choice justifies ends irrespective of means. Money becomes the medium of all value. Solidarity and good will are invalidated. Relationships are conducted on a quid pro quo basis. However, agents can freely opt out of this cynical race to the bottom by embracing a more expansive range of coherent action. (shrink)

This chapter uncovers the complex negotiations for authority in various representations about futures of life which have been advanced by different branches of the sciences, and have culminated in the emerging concept of life as algorithm. It charts the historical shifts in expertise and representations of life, from naturalists, to mathematical modellers, and specialists in computation, and argues that physicists, game theorists, and economists now take a leading role in explaining and projecting futures of life. The chapter identifies Richard (...) Dawkins and Max Tegmark at the forefront of the concept of life as algorithm: the first inspired by game theory as a means to study evolution; the second proposing that a materialist basis of life could place humans and artificial intelligence on an equal footing. Through close reading of their respective texts, the chapter demonstrates that both thinkers consider life as an algorithm programmed to achieve success in survival and reproduction. (shrink)

Richard Wright gave a series of lectures in Europe from 1950 to 1956, collected in the following year in the volume, White Man, Listen! One dominant theme in all four essays is that expanding the moral imagination is centrally important in repairing our racism-benighted globe. What makes Wright’s version of this claim unique is his forthright admission that expanding the moral imagination necessarily involves pain and suffering. The best place to hear Wright in regard to the necessary pain of (...) expanding the moral imagination, I would argue, is his poetry collection, This Other World: Projections in the Haiku Manner. To wit, for Wright the necessary pain of expanding one’s moral imagination is the loneliness that results from delegating to others—in the etymological sense of “deputizing or committing”—one’s whiteness qua privilege or social capital. In conclusion, lonely delegation constitutes an imperative template from Wright regarding the painful expansion of our own moral imagination, in the service of social justice for economically oppressed communities of color across the globe. In recent analytic literature on the Trinity we have seen a variety of "social" models of the Trinity. By contrast there are few "non-­‐social" models. One prominent "non-­‐social" view is Brian Leftow's "Latin Trinity." I argue that the name of Leftow's model is not sufficiently descriptive in light of diverse models within Latin speaking theology. Next, I develop a new "non-­‐social" model that is inspired by Richard of St. Victor's description of a person in conjunction with my appropriating insights (...) about indexicals from David Kaplan and John Perry. I point out that the copula in tokens of statements like, "I am the Father," is an ambiguous term and when used by a certain divine person a different proposition is affirmed. Central to this model is the claim that the copula bears the "is of identity" and the "is of numerical sameness without identity." Further, I show that Leftow's model employs two concepts of "person," a Lockean one and a Boethian one, and mine employs Richard of St. Victor's. I describe Leftow's model as a "hard non-­‐social" model and mine as a "soft non-­‐social" model that is nearer to some social models. I conclude that Leftow's model is not the lone candidate among "non-­‐social" models and that the variety of "non-­‐social" models has yet to be exhausted. (shrink)

Depuis Gintis est un économiste senior et j’ai lu certains de ses livres précédents avec intérêt, je m’attendais à un peu plus de perspicacité dans le comportement. Malheureusement, il fait les mains mortes de la sélection de groupe et la phénoménologie dans les pièces maîtresses de ses théories du comportement, et cela invalide en grande partie le travail. Pire encore, puisqu’il montre un si mauvais jugement ici, il remet en question tout son travail précédent. La tentative de ressusciter la sélection (...) de groupe par ses amis à Harvard, Nowak et Wilson, il y a quelques années, c’était l’un des principaux scandales en biologie au cours de la dernière décennie, et j’ai raconté la triste histoire dans mon article 'Altruism, Jesus and the End of the World-how the Templeton Foundation bought a Harvard Professorship and attacked Evolution, Rationality and Civilization -- A review of E.O. Wilson 'The Social Conquest of Earth' (2012) et Nowak and Highfield 'SuperCooperators' (2012).' Contrairement à Nowak, Gintis ne semble pas être motivé par le fanatisme religieux, mais par le fort désir de générer une alternative aux sombres réalités de la nature humaine, facilitée par le manque (quasi universel) de compréhension de la biologie humaine fondamentale et le slateisme vierge des scientifiques comportementaux, d’autres universitaires et du grand public. Gintis attaque à juste titre (comme il l’a fait à maintes reprises) les économistes, les sociologues et d’autres scientifiques du comportement pour ne pas avoir un cadre cohérent pour décrire le comportement. Bien sûr, le cadre nécessaire pour comprendre le comportement est évolutif. Malheureusement, il ne parvient pas à en fournir un lui-même (selon ses nombreux critiques et je suis d’accord), et la tentative de greffer le cadavre pourri de la sélection de groupe sur toutes les théories économiques et psychologiques qu’il a généré dans ses décennies de travail, n’a fait qu’invalider tout son projet. Bien que Gintis fasse un vaillant effort pour comprendre et expliquer la génétique, comme Wilson et Nowak, il est loin d’être un expert, et comme eux, le calcul l’aveugle juste aux impossibilités biologiques et bien sûr c’est la norme en science. Comme Wittgenstein l’a noté sur la première page de la culture et de la valeur « Il n’y a pas de dénomination religieuse dans laquelle l’utilisation abusive des expressions métaphysiques a été responsable de tant de péchés qu’il l’a en mathématiques. » Il a toujours été clair que un gène qui provoque un comportement qui diminue sa propre fréquence ne peut pas persister, mais c’est le cœur de la notion de sélection de groupe. En outre, il a été bien connu et souvent démontré que la sélection de groupe réduit juste à la condition physique inclusive (sélection de parents), qui, comme Dawkins l’a noté, est juste un autre nom pour l’évolution par sélection naturelle. Comme Wilson, Gintis a travaillé dans cette arène pendant environ 50 ans et n’a toujours pas compris, mais après le scandale a éclaté, il ne m’a fallu que 3 jours pour trouver, lire et comprendre le travail professionnel le plus pertinent, comme détaillé dans mon article. Il est ahurissant de se rendre compte que Gintis et Wilson n’ont pas été en mesure d’y parvenir en près d’un demi-siècle. Je discute des erreurs de sélection de groupe et de phénoménologie qui sont la norme dans le milieu universitaire comme des cas spéciaux de l’échec quasi universel de comprendre la nature humaine qui détruisent l’Amérique et le monde. Antes de comentar en "La nueva ciencia de la mente", primero ofrezco algunos comentarios sobre filosofía y su relación con la investigación psicológica contemporánea como se ejemplifica en las obras de Searle (S), Wittgenstein (W), Hacker (H) et al. Ayudará a ver mis reseñas de PNC (Filosofía en un Nuevo Siglo), TLP, PI, OC, Making the Social World (MSW) y otros libros por y sobre estos genios, que proporcionan una descripción clara del comportamiento de orden superior, no se encuentra en (...) psicología ni filosofía, a la que me referiré como el marco de WS. Al igual que con tantos libros de filosofía, podríamos parar con el título. Como indican las citas y comentarios anteriores y en mis otras reseñas y los libros que cubren, hay razones convincentes para los problemas que enfrentamos al describir la psicología del orden superior considerado como conceptual y no científico. Esto debería ser cristalino para todos, pero la envidia de la ciencia y el olvido casi completo a WSH, etc. es un modo la! Pero como H señala anteriormente, los temas discutidos aquí son todo acerca de los juegos de idiomas y no tienen nada que ver con la ciencia. De hecho, como de costumbre, si uno traduce al inglés claro hay muy poco interés aquí, y ciertamente nada no dicho antes y mejor por WS, etc. innumerables veces desde los años 30 (véase, por ejemplo, The Blue and Brown Books de 1933- 35). No es de extrañar que no haga referencias significativas a ninguno de los libros o personas anteriores (¡la única referencia a S es un artículo de 1958!), aunque en mi opinión están en la parte superior de la lista de las principales figuras de la psicología descriptiva. En la p119 nos dice que la clave de todo esto es averiguar cómo "... un proceso cognitivo a nivel personal puede pertenecer a un sujeto representativo. Esta es la tarea de la segunda mitad del libro". Pero W hizo esto hace 80 años y ya que tenemos las explicaciones bellamente claras de WSH, H&M, etc., no tiene sentido torturarse con la prosa bastante sin rumbo y opaca que se desvía terminan en Sartre, Heidegger, Husserl y Frege, con un toque de ensalada de palabras posmodernista para buena medida. Un esfuerzo valiente en un tema interesante, pero en última instancia agotador e infructuoso. After some years (or millennia) most works would no longer be considered eligible for "review." But an exception is called for, if the thrust of an older work is closely paralleled in a much more modern piece, as is the case between Plato's Theaetetus and Richard Rorty's acclaimed, and more recent volume, Philosophy and the Mirror of Nature. To fully understand and appreciate Rorty 's contribution to the subjects he raises, one must study his book in conjunction with Plato's (...) Theaetetus-where very similar issues have been discussed before. Both works concern a central question for philosophy: "What is knowledge?" The discussants in Plato's dialogue the Theaetetus, never do succeed in finding a satisfactory definition for knowledge, yet they at least realize to avoid thinking they know about the subject when, in fact, they lack that knowledge. Since Rorty explores some new (and not so new) ideas on these topics, Plato's discussants ask him a few questions. (Reprinted from original in Antioch Review). (shrink)

In 1951 John Rawls expressed these convictions about the fundamental issues in metaethics: [T]he objectivity or the subjectivity of moral knowledge turns, not on the question whether ideal value entities exist or whether moral judgments are caused by emotions or whether there is a variety of moral codes the world over, but simply on the question: does there exist a reasonable method for validating and invalidating given or proposed moral rules and those decisions made on the basis of them? For (...) to say of scientific knowledge that it is objective is to say that the propositions expressed therein may be evidenced to be true by a reasonable and reliable method, that is, by the rules and procedures of what we may call "inductive logic"; and, similarly, to establish the objectivity of moral rules, and the decisions based upon them, we must exhibit the decision procedure, which can be shown to be both reasonable and reliable, at least in some cases, for deciding between moral rules and lines of conduct consequent to them.1 In this passage Rawls reconfigured the issue of moral objectivity and so reoriented the practice of metaethics from linguistic analysis to rational methodology. In so doing, his work has provided inspiration to philosophers as disparate in normative views as Thomas Nagel,2 Richard Brandt3, Alan Gewirth4, and David Gauthier.5 Rawls replaced the Moorean question, Do moral terms refer? with the Rawlsian question, Can moral judgments be the outcome of a rational and reliable procedure? He later gave a resoundingly positive answer to this question6 and later still, a more tentative one.7 Rawls' considered qualification of his earlier enthusiasm about the extent to which moral philosophy could be "part of the theory of rational choice"8 is a tribute to the seriousness with which he took his critics' objections. Here I review the recent edited volume "Richard Kearney's Anatheistic Wager: Philosophy, Theology, Poetics.".

This review of Richard Tuck's Free Riding conveys Tuck's crucial distinction between the logic of collective action which fails due to the problem of causal negligibility, and free riding, which has been modeled as a Prisoner's Dilemma and involves casually impacting another actor in an adverse manner. Tuck also distinguishes the practice of voting which he argues neither fails due to the worry of causal negligibility or due to free riding; instead it represents a problem of achieving sufficiency of (...) votes representing a minimum winning coalition. This article clarifies how the problem of collective action resembles perfect free market competition which is defined to be characterized by a state in which no single agent can impact the price of a good. Similarly, in a large scale collective action, no single actor can have a causal impact on the outcome of the vast enterprise. This inability to make a difference due to the negligibility of each individual's causal power differentiates collective action and the tragedy of the commons from other social problems. (shrink)

Richard M.Gale reviewed my book in Notre Dame Philosophical Reviews in May 2009. The overall conclusion of my reply is that although Gale repeatedly claims that the book is defective, his review has not identified any genuine defects.

A synthetic glance about the basic outlines of Hare's Meta-ethics is offered in this paper to support the idea that Hume's law is still a productive resource for ethical studies. Hare accepted the emotivist premise that moral judgments do not, in the same way as ordinary statements do, state matters of fact that are either true or false, but denied that therefore they must be forms of exclamation. The essential character of moral discourse consisted, not, as the emotivists had held, (...) in its links with subjective attitudes, but with action; moral judgments were prescriptive, in that they expressed commitments to action on the part of the person uttering them, and at the same time their rationality was assured by their universalisability, i.e. their property of applying not merely to the person uttering them, but to all similar persons in similar circumstances. This book presents a selection of theoretical and applied texts of Richard Hare, as well as an appendix which includes several fundamental studies for the understanding of the ethics of 20th century.

Ethics of Richard M. Hare is widely considered as a classical example of the strong internalistic theory of motivation: he is thought to believe that having a moral motive is a sufficient condition to act accordingly. However, strong internalism has difficulties with explaining the phenomenon of acrasia and amoralism. For this reason some critics charge him with developing a false theory of moral motivation. In the article I present Hare's answer to these questions by dividing the discussion about motivation (...) into three levels: semantical, epistemological, and ontological. I also explain his concept of internal motivation and argue that his theory, contrary to what his critics assume, may be called a weak motivational internalism. (shrink)

Habermas frequentemente adota o termo Estado de direito na sua obra Direito e democracia: entre facticidade e validade. O objetivo deste artigo, então, consiste na investigação da possibilidade desse conceito, no seu fundamento e na apresentação dos problemas dele decorrentes, contrapondo-o especificamente a sua antítese, isto é, ao monismo entre Estado e direito de Kelsen. Ocorre que a filosofia habermasiana, conforme entendimento do artigo, implica a adoção de uma teoria dualista entre os conceitos de Estado e de direito. Observa-se, assim, (...) o compromisso do filósofo alemão com a reformulação de uma doutrina jurídica específica e sua radical incompatibilidade com o positivismo kelseniano. (shrink)

O artigo analisa a leitura crítica de Hans Kelsen acerca da concepção jurídico-política de Thomas Hobbes, considerando críticas posteriores à própria interpretação de Kelsen. Para tanto, investigou-se primeiramente a posição de Kelsen sobre o jusnaturalismo buscando esclarecer conceitos centrais como os do ser e dever-ser e como o autor os associa a Hobbes. Nesse sentido, observouse a limitação da leitura de Kelsen em relação à filosofia jurídica do autor – uma doutrina jusnaturalista metafísica, tendo na regra de ouro o fundamento (...) natural para o direito positivo. Em contraposição, procurou-se apresentar uma postura crítica, que contesta a posição jusnaturalista atribuída a Hobbes e sustenta a tese de que o autor inglês é um precursor do positivismo jurídico. O artigo tem como objetivo apresentar o problema da determinação do sentido das normas para o Kelsen considerando a flexibilidade do quadro de interpretações. Expõe, primeiramente, a suposta transição do conceito de interpretação normativa, passando de um formalismo-normativismo restritivo para um realismo jurídico a partir das suas últimas obras; em um segundo momento apresenta o decorrente conflito ainda atual constituído por essas reformulações. Finalmente, defende a hipótese de superação da dicotomia formalismo-normativismo versus realismo jurídico através de uma leitura realista normativista.

O trabalho busca esclarecer dois pontos centrais da Filosofia política de Maquiavel – as figuras da Virtù e da Fortuna. A virtú deve ser vista como uma forma do livre-arbítrio do governante, sendo a principal variável na condução do principado.Destaca-se, também, a utilização da variável nacontestação aos valorestradicionais. Já a Fortuna constitui-se na indeterminabilidade de parte dos resultadosdo governo: ela deve ser dominada, conquistada para o benefício do príncipe.

O objetivo do artigofoi especular sobre a epistemologia proposta por David Hume (1711-1776), especificamente a perspectiva empirista e cética. Procurou-se, assim, expor os principais conceitos da sua filosofia, especialmente acrítica à concepção de causalidade, o problema da probabilidade e os conceitos de percepções, imagens e ideias. Finalmente buscou-se expor uma interpretação que entende haver um ceticismo mitigado no autor e a superação de uma teoria do conhecimento exclusivamente psicológica.

O presente artigo aborda o problema da soberania para Hans Kelsen. Tem como objetivo analisar a posição do autor sobre o tema (especialmente através do texto Sovereignty), traçando paralelamente algumas considerações. Ocorre que para Kelsen o conceito de soberania mostra-se impreciso a partir da doutrina tradicional. Ainda, mesmo superando essa doutrina e a teoria dualista, também o conteúdo do direito nacional e internacional permanece inalterado. Portanto, prova-se a irrelevância de tal para a teoria jurídica.

O artigo investigou o método para uma filosofia intercultural a partir da Ibero-América, de Raul Fornet-Betancourt. Partiu-se especificamente do texto do autor para posteriormente fornecer considerações críticas aos seus posicionamentos. Nesse sentido, analisou-se a originalidade do tema, a filosofia da libertação como modelo de diálogo intercultural, seus pressupostos hermenêuticos e epistemológicos e, por fim, o pensamento ibero-americano como base para uma filosofia intercultural. No final do trabalho apresentou-se seis críticas ao texto estudado – o problema da arrogância e dissimulação filosófica, (...) a adoção tácita de um platonismo e a não originalidade filosófica, o problema da falácia naturalista e do falsificacionismo e, finalmente, a não razoabilidade política das propostas. Com este artigo procura-se introduzir a questão da origem social das normas morais e jurídicas a partir da obra de Hans Kelsen e solucionar, de forma breve, o problema da conciliação do método lógico-transcendental da Teoria pura com a filosofia positivista e empirista do autor.
